Our Terms of Service

1) Acceptance of Terms

These Terms govern your access to and use of Smart Testing’s websites, services, and the Krilin platform (collectively, the “Services”). By accessing or using the Services, you agree to these Terms.

2) Our Services (Overview)

Smart Testing provides software, integrations, and the Krilin platform (currently under development) to help businesses orchestrate third-party services such as identity verification (Sumsub) and cloud infrastructure (Oracle Cloud).
Smart Testing does not provide financial services, does not custody or transmit client funds, and currently performs no on-chain (blockchain) activity.

3) Accounts & Acceptable Use

You are responsible for your account, credentials, and activity. You agree not to:

• misuse or attack the Services;
• reverse engineer except as permitted by law;
• infringe IP or privacy rights;
• use the Services for unlawful activity, including money laundering, terrorist financing, or sanctions evasion;
• upload malicious code;
• circumvent security controls.

4) Third-Party Services

The Services may integrate or reference third-party services (e.g., Sumsub for KYC/KYB, Oracle Cloud for hosting, Utila planned). Smart Testing does not control third-party services and is not responsible for their content, performance, or policies. Use of third-party services may be subject to separate terms.

5) No Custody / No Transmission

Smart Testing and Krilin do not hold, receive, store, or transmit fiat or digital assets for customers. Any transactions between you and third parties are outside Smart Testing’s control.

6) Beta / Pre-Release Features

Krilin and certain features may be labeled alpha, beta, or preview; they are provided for testing on an AS IS basis and may change, break, or be withdrawn without notice.

7) Intellectual Property

All IP rights in the Services are owned by Smart Testing or its licensors. You receive a limited, revocable, non-exclusive, non-transferable right to access and use the Services in accordance with these Terms.

8) Privacy & Data Protection

Our Privacy Policy explains how we process personal data (including data collected through Sumsub). By using the Services, you consent to such processing consistent with that policy and applicable law.

9) Suspension & Termination

We may suspend or terminate access for violations of these Terms, security risks, legal requirements, or failure to pay applicable fees (if any). You may stop using the Services at any time.

10) Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” SMART TESTING DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SMART TESTING WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL. SMART TESTING’S TOTAL LIABILITY FOR ANY CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNTS PAID BY YOU (IF ANY) FOR THE 3 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY.

12) Indemnification

You will indemnify and hold Smart Testing harmless from claims arising out of your unlawful or prohibited use of the Services, your breach of these Terms, or your violation of third-party rights.

13) Export Controls & Sanctions

You must comply with applicable export control and sanctions laws. You may not use the Services if you are located in, or are a resident of, a comprehensively sanctioned country or are a denied party.

14) Governing Law & Dispute Resolution

These Terms are governed by the laws of the Dominican Republic, without regard to conflicts-of-law rules. Courts located in Santo Domingo, Distrito Nacional will have exclusive jurisdiction, unless a different forum is mutually agreed in writing.

15) Changes

We may update these Terms; material changes will be notified by reasonable means. Continued use after the effective date constitutes acceptance.
